KampalaSnap — Terms of Service

These are the rules of using KampalaSnap. Read them carefully — by creating an account, listing a product or service, placing an order, or even just browsing as a guest, you agree to these terms.

If you don't agree, please don't use the app or the website.


1. Who we are and what we do

KampalaSnap is a mobile marketplace where Ugandan buyers, sellers, and service providers meet. We operate under Hobermalo, the holding company that owns the brand. We provide:

We are not a party to the transaction between a buyer and a seller. We provide the platform; the contract for a product or service is directly between buyer and seller.


2. Accounts

2.1 Who can sign up

You can create an account if you are 18 years or older and a legal resident of Uganda or another country we serve. If you create an account on behalf of a business, you confirm you have the authority to do so.

2.2 Sign-up methods

We offer three ways to create an account: phone (SMS OTP), Google, and Apple. See our Privacy Policy for what each method collects.

2.3 Account responsibility

You are responsible for everything that happens on your account. Keep your password and OTPs private; don't share account access; tell us immediately if you suspect unauthorized use by emailing support@kampalasnap.com.

2.4 One account per person

You may only operate one buyer account. If you also sell, the seller shop attaches to the same account. Multiple accounts to evade restrictions, fake reviews, or manipulate visibility are grounds for permanent removal.


3. Buying

3.1 How orders work

When you place an order, your payment goes to escrow — we hold the money via PesaPal until you confirm delivery (with the delivery PIN) or 48 hours pass after the seller marks the order delivered. Only then is the money released to the seller, less applicable platform fees.

Some sellers offer COD. When you choose COD you pay the rider directly, not through escrow. We cannot guarantee or refund COD payments — those disputes go directly to the seller. We strongly recommend escrow paid delivery for any item over UGX 50,000.

3.4 Pricing and currency

All prices are in Ugandan Shillings (UGX). The price you see at checkout is the price you pay. We display delivery fees separately when the seller has configured delivery zones.


4. Selling

4.1 Becoming a seller

Anyone with a verified phone number can list products under the self-promoted (non-affiliate) tier. To sell through affiliate creators or earn premium placement, your shop must be verified. See the in-app Become a Seller flow.

We reserve the right to remove any listing for any reason; repeated violations result in shop removal.

4.4 Fees

KampalaSnap charges a platform fee of 5% on every completed escrow order. This fee is deducted from the seller's payout. Buyers see the full price; sellers see the post-fee earnings in their wallet. Additional fees for paid promotions (flash sales, boosts, video ads) are charged at purchase time per the in-app Pricing screens.

Verified sellers may withdraw their wallet balance to a Mobile Money account or registered bank account on Tuesdays and Fridays (Uganda time). The withdrawal gate exists to give buyers a dispute window before money leaves the platform.


5. Service providers

5.1 Service profiles

Verified service providers (plumbers, photographers, mechanics, etc.) have profiles in the Services directory. Buyers contact them via WhatsApp / phone shown on the profile. Services do not go through escrow today — the contract is directly between buyer and provider.

6. Content you post

6.1 Your content

Videos, photos, product descriptions, reviews, posts, comments — you own them. By posting them on KampalaSnap, you grant us a non-exclusive, royalty-free license to host, display, and distribute them within the platform (including in discovery surfaces, video feeds, and search results) for as long as your account is active.

6.2 What you can't post

6.3 Moderation

We review reported content and remove what violates these terms or our community guidelines. We are not required to monitor all content proactively, but we do use automated screens at upload time for obvious violations.


7. Disputes

If a transaction goes wrong, raise a dispute in the app within 72 hours of delivery. Our team reviews the evidence and resolves to refund the buyer or release escrow to the seller. The full process, acceptable reasons, and our admin team's decision framework are documented in the Disputes Policy.

By using KampalaSnap, you agree that disputes about marketplace transactions are subject to our resolution process before any legal action. This does not waive your statutory consumer protection rights under Ugandan law.


8. Suspension and termination

We may suspend or terminate your account if you:

We will tell you why your account was suspended (unless legally prevented) and how to appeal. Appeals go to support@kampalasnap.com.

9. Payments and money

Payments are processed by PesaPal (https://www.pesapal.com) and the relevant Mobile Money provider. We are not a money services business or financial institution; we operate the escrow mechanism described above through licensed providers.

If a payment fails, is reversed, or is disputed at the payment processor level, we apply the same dispute resolution process to determine the outcome on the platform side.


10. Intellectual property

The KampalaSnap name, logo, app design, and code are owned by Hobermalo. You may not copy, redistribute, reverse-engineer, or create derivative works of our intellectual property except as permitted under fair use or with written permission.

11. Disclaimer of warranties

We provide the platform "as is." We do not guarantee:

We do guarantee what's in our Disputes Policy: if a transaction goes wrong, we hold the money in escrow until it's resolved.


12. Limitation of liability

To the maximum extent permitted by Ugandan law, KampalaSnap and its parent Hobermalo are not liable for:

Our total liability to you for any claim related to the use of the platform is capped at the total platform fees you have paid us in the 12 months preceding the claim, or UGX 100,000, whichever is higher.

Nothing in this clause excludes liability for death, personal injury caused by our negligence, or fraud — those exclusions are void where prohibited by law.


13. Changes to these terms

We may update these terms when our practices change. For material changes (fee changes, new prohibited categories, expanded liability), we will notify active users via the app at least 14 days before the change takes effect. Continuing to use the platform after a change takes effect counts as acceptance.

The "Last updated" date at the top reflects the most recent change.


14. Governing law and disputes with us

These terms are governed by the laws of Uganda. Any dispute that cannot be resolved through our internal process will be settled in the courts of Kampala, Uganda. If you are using the platform from outside Uganda, you accept Ugandan jurisdiction by using it.
